ORDINANCE No. 7-4
An ordinance prohibiting unreasonably loud, disturbing and unnecessary noise, providing for enforcement by fine, containing, a savings clause and revoking all ordinances in conflict herewith. Be it ordained by the City Council of the City of Kenedy that: Section 1. Unreasonably loud, disturbing and unnecessary noise. It shall be unlawful for any person to make an unreasonably loud, disturbing and unnecessary noise in any public or private place in the city which causes material distress, discomfort or injury to persons of ordinary sensibilities in the immediate vicinity of such noise. Section 2. Examples. The following, among other examples not herein named, are declared to be unreasonably loud, disturbing and unnecessary noise. A. Any motor vehicle so out of repair or as modified (that is, not standard equipment for the type vehicle, or which violates state regulations for equipment or emissions) that it creates an unreasonable or unusual grating, grinding, rattling, or any other loud and unreasonable sound. B. Any amplified sound that is part of or connected to a speaker system of a motor vehicle operated on a public street or park in such a manner as to disturb the peace, quiet and comfort of others. C. Playing a radio, stereo, phonograph, recorder, musical instrument or similar device used in the amplification of noise in a manner and in such a volume in a residential area to disturb a person of reasonable sensibilities or in a commercial area where the noise effects the reasonable conduct of commerce of businesses. Section 3. Activities Excepted. The following activities shall be excepted from this ordinance: 1. The emission of any sound for the purpose of alerting persons to the existence of an emergency, danger, or attempted crime, or was produced pursuant to any safety rule or regulation of any governmental entity or agency. 2. The sound was produced by an authorized emergency vehicle. 3. The sound was produced during a lawful event sanctioned by the city administrator or chief of police. Section 4. Penalty. Any person violating any provision of this ordinance shall be fined not less than $50.00 nor more than $500.00 for each offense. Enforcement hereunder shall not require the pleading or proving of any culpable mental state. Section 5. If any provision of this ordinance being adopted shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. All ordinances or parts of ordinances or policies adopted by the City and in conflict with the provisions of the ordinance hereby adopted are repealed. KARNES CITY INDEPENDENT SCHOOL DISTRICT NOTICE OF PUBLIC HEARING CONVEYANCE OF REAL PROPERTY
