Suspects indicted in police assault, escape cases

By Jason Clay Jansky

Two local men were indicted August 2 in separate cases alleging difficulties they gave local police.

Christopher Villarreal was charged with "escape while arrested" and currently is being held on $46,000 bond.

Police allege the 17-year-old Karnes City resident was at a home on North Market Street when they arrived there July 15 to investigate a disturbance report. Karnes County Sheriff Deputy David Kunschik was one of the officers at the scene.

Shortly after he arrived to investigate, he recognized Villarreal’s face.

"He knew that (Villarreal) had an outstanding warrant for his arrest. He approached Christopher and told him there was a warrant, placed him in cuffs, and began to walk to the patrol car."

On the way to the car, Villarreal broke free and took off running, according to the police report. Police gave chase, but were unable to keep up. Kunschik noted he last saw Villarreal disappear behind a house near Milam and Park streets.

The next day, an off-duty Kenedy police officer noticed Villarreal on Runge Street in Karnes City and notified the sheriff’s department. Karnes City and county police arrived shortly thereafter and arrested Villarreal without incident.

Police also interviewed two women at the home on North Market Street shortly after arresting Villarreal. One woman there said Villarreal had assaulted her and police later filed assault charges against him in response.

The original warrant out for Villarreal’s arrest was for "burglary of a building" and "burglary of a coin-operated machine." He also has been charged with giving a "false report to peace officer," a class B misdemeanor.

In a separate case, Kenedy resident Juan Escamilla was indicted by the same grand jury August 2 on felony charges of "attempting to take weapon from peace officer" and two felony counts of "assault (public servant)."

Kenedy police are alleging the 35-year-old Kenedy resident violently resisted arrest May 4 when they arrived at his home on Victoria Street to investigate a call his wife had made to the sheriff’s department.

"When we arrived, we met with the complainant and she advised that her husband was in the restroom and that he was on drugs," Kenedy Police Sergeant Jeremy Stevens said. "We knocked on the (restroom) door and got no answer. We tried again, announced ‘police,’ and still got no answer."

Fearing Escamilla may need medical attention, police entered the restroom.

"The subject … was standing in the restroom holding several syringes and items that we knew to be drug paraphernalia," Stevens said. "When we attempted to detain him, at that time he shoved the syringes in the toilet and started flushing. He was pulled away, put on his belly, and told he was under arrest."

Police say at that point, Escamilla began resisting.

"During the struggle, I had taken out my (baton), and I warned him that if he kept fighting or attempting to get off the floor, he would be struck," Stevens said. "He continued fighting; he grabbed the baton, took it away from me, and threw it on the floor."

Officers Fernando Martinez and Felix Casanova also were injured during the struggle, according to Stevens. The three officers eventually gained control of the situation and were able to detain Escamilla.

He also was charged with "resisting arrest," "Tampering with or fabricating physical evidence," and "possession of a controlled substance."

He remains in custody on $150,000 bond.
