Kenedy police will seek indictment against Grimaldo

Kenedy’s police chief announced March 19 his department would be seeking a grand jury indictment against a 50-year-old Pawnee man suspected of shooting his wife in the stomach March 3.
Chief Duane DuBose said he’s collected enough evidence that he feels confident seeking the indictment for felony aggravated assault, asserting the alleged offender Miguel Grimaldo intentionally or knowingly acted recklessly the night his wife Susana was shot.
"With the evidence from the victim (and) from witnesses that were around (we believe) that she was shot with a firearm," he said, noting that police did not collect evidence that showed Grimaldo had an attempt to kill. "For the charge to be attempted murder, you would have to prove intent — that he intended to kill her. We do not see any evidence that supports (that) claim."
The grand jury convenes April 2 and will decide then whether or not Grimaldo should be charged with aggravated assault, charged with a lesser offense, or not charged at all.
Kenedy police found the couple driving west on State Highway 72 March 3 after they received a report of a shooting on 515 Lavaca Street.
Susana Grimaldo had been shot in the abdomen with a 38-caliber handgun and both she and her husband claimed the incident was an accident. Both said they were heading home from their friend’s house on Lavaca Street before calling EMS.
Grimaldo was released from the Karnes County Jail March 17 on $20,000 bond. His original bond amount of $300,000 was reduced by the district attorney’s office.
